Welcome to the proprietary electronic underwriting portal (the “Portal”) ofAttune Insurance Services, LLC (“Attune”). If you are a producer and have an Attune Producer Agreement, these Terms of Use are intended to be read in conjunction with that Agreement, which incorporates them by reference.  These Terms of Use also apply to your use of the Customer Care Center, which Attune maintains to respond to any business inquiries and to assist with insurance transactions not completed through the Portal.  Additional important information and other terms and conditions which govern your relationship with Attune are provided on the Corporate, Licensing and Legal Information page of our website here.

By proceeding to access Attune’s Portal, you agree to the following Terms of Use:

AUTHORIZED USERS


Attune’s Portal is for the use of authorized users only.  Access to the Portal is granted only to licensed insurance producers who: (1) have an in-force Producer Agreement with Attune (an “Attune Producer”); or (2) have been granted permission to use the Portal pursuant to an approved contractual arrangement with an Attune Producer (a “Sub-Producer”).  Within your organization, access may be granted only to those employees who are either properly licensed as individual insurance producers, or are under the direct supervision of such licensed employees, in accordance with your policies and procedures.  You are responsible for ensuring that access to the Portal is granted only to those individuals or entities with proper authority to enter into insurance transactions on your behalf.  

Attune’s Portal is designed to facilitate the exchange of relevant information concerning your client’s (the insurance consumer’s) business, and to make the completion of the proposed insurance transaction faster, easier and more cost-efficient than traditional application and quotation processes.

As a condition to effectuating insurance transactions on Attune’s Portal, you acknowledge and agree that you are acting solely in your capacity as an insurance broker, irrespective of any licensing designation that state insurance laws employ and irrespective of whether you are working with another producer or sub-producer.  Under no circumstances, are you acting as an agent on behalf of Attune or any of the insurers Attune represents.

In our sole discretion, we may suspend your access to Attune’s Portal:  (a) pending resolution of any complaint or allegation that you have misused the system or failed to comply with any applicable law or regulation; (b) if your producer’s license is suspended or revoked; or (c) if you have materially breached any of the terms or conditions of your Producer Agreement, Sub-Producer Agreement or these Terms of Use, including , but not limited to, the requirement that  you maintain errors and omissions insurance.  We may revoke your access if any dispute, complaint, breach or allegation is not resolved to our satisfaction.

AUTHORIZED SCOPE OF USE

Attune does not solicit, negotiate, or sell any insurance products for personal, family, or household purposes.  Attune’s Portal should, therefore, only be used for submitting applications for commercial insurance policies and completing commercial insurance transactions on behalf of businesses or professionals.  

To the extent that you provide any information regarding your client via Attune’s Portal or through our Customer Care Center, you agree and represent that:

* You are acting on behalf of and in the best interests of your client, and have express authority from your client to submit information to Attune;
* You have evaluated the information and determined that it: (1) does not contain personally identifiable or health related information; and (2) relates solely to the purchase of commercial insurance for your client’s business or profession;
* You have been authorized by your client to permit Attune to share such information with our data analytic consultants and service providers as described in these Terms of Use; and
* Other than your customer lists (also known as expirations), all data that we collect or generate for the functioning of Attune’s Portal and our underwriting processes and activities are our intellectual property.

You further agree that you will not attempt to replicate, reproduce, or reverse engineer Attune’s Portal in violation of Attune’s proprietary intellectual property rights for any purpose.  

Attune may monitor your use of the Portal to ensure that your activities on this site fall within the scope of these Terms of Use.  System maintenance may also entail monitoring your activity and use of the Portal.  You consent to such monitoring and agree that if such monitoring reveals possible evidence of criminal activity, we or our representatives will provide such evidence to law enforcement officials, to the extent required by law.

USE OF DATA ANALYTICS


We engage data analytics consultants and service providers, such as Google Analytics, to assist us in examining and evaluating data sets to uncover patterns, correlations, market trends, customer preferences and other useful information that helps us deliver insurance products and make Attune’s Portal a more effective and cost-efficient way for you and your client to do business.  

Our data analytics consultants and service providers will have access to certain non-personal, commercial information that you provide us and/or we lawfully collect from other sources.  This information may include data that: (i) is specific to your client’s business, such as the company’s credit history, location, or revenue; or (ii) generally relates to your client’s industry or profession, like market trends.    

You understand and agree that Attune is authorized to conduct credit checks of your clients (including requesting credit bureau reports from credit reporting agencies and other sources) for the purpose of evaluating your client’s eligibility for commercial insurance products only.  

Attune does not collect, use, or share any non-public personally identifying information, or information regarding race, religion, gender, sexual orientation, disability or other criteria which is prohibited by law in insurance underwriting or in the general conduct of business.  As a condition of the use of Attune’s Portal, you agree that you will not engage in unlawful discrimination or other unlawful conduct.

Attune takes all steps necessary to ensure that any information we share with our data analytics consultants and service providers is appropriate and permissible under applicable data privacy and security laws and regulations, including New York Cybersecurity Regulation (23 NYCRR 500).

USE OF COOKIES


Please be aware that we use cookies to give you the best experience on Attune’s Portal.  A cookie is a small text file that a website saves on your computer or mobile device when you visit the site.  It enables the website to remember your actions and preferences (such as login, language, font size and other display preferences) over a period of time, so you don’t have to keep re-entering them whenever you come back to the site or browse from one page to another.
